for the sale of goods through the online store operated through pelek.es under the name PELEK Distribution s.r.o. .

The protection of personal data is very important to us. The purpose of this document is to inform you about all information related to the processing of your personal data if you use the online store operated through pelek.es;. We recommend that you read these Personal Data Processing Policies. If you have any additional questions about the processing of your personal data, please contact us by email info@pelek.eu.

Definitions. For greater clarity and guidance, these Personal Data Processing Policies set out the terms that are frequently repeated:

Online store: online store operated by the controller under the name PELEK Distribution s.r.o. through the online store pelek.es;

GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council;

Personal data: any information about the User that allows them to be identified directly or indirectly;

User: the natural person to whom the personal data relates, who will generally be a customer or potential customer, also referred to as “you”;

Processor: performs personal data processing activities on the basis of a contract or other authorization from the controller;

1. Basic data

Your personal data is collected through the online store pelek.es; and/or directly by us. In both cases, we may act as the data controller. If your personal data is processed in the online store pelek.es;, please read its Personal Data Processing Policy .

We process the following personal data about you:

— first and last name, contact details (especially email address and telephone number), address;

— billing details and bank details (data necessary for accounting);

— information you provide to us as part of communication with us (especially your questions and responses to your inquiries, and communication with you).

We do not process special categories of personal data.

2. The purposes for which we process personal data and the reasons for processing

2.1 Fulfillment of the contractual relationship and related legal obligations. The reason for processing personal data is the fulfillment of the purchase contract and related obligations (delivery of goods, accounting, handling complaints, or if you exercise your right to return goods within the statutory period). We will process your first and last name, contact details (residential address and delivery address, email address, and telephone number), as well as other billing details. Personal data is processed for the duration of the contractual relationship and subsequently for 4 years after its termination (we have an interest in retaining certain personal data related to the purchase contract in order to protect our interests). We are legally required to archive accounting and tax documents. The retention period for this data may be up to 10 years from the end of the tax period in which performance took place. If necessary for delivery and payment, the personal data we collect will be transferred to the authorized transport company or authorized credit institution.

2.2 Payment by card. If you provide us with your payment card details, we do not have access to the complete information. We only know that you are paying by card, and the card details are processed by the recipients of this information, who process the payment on our behalf.

2.3 Order processing. To process your order, we also work with other service providers (carriers and others) who help us fulfill concluded contracts. Your data is transferred to these partners solely for the purpose of fulfilling the obligations under the purchase contract.

2.4 Communication with customer service, complaints, or other inquiries. If you have contacted us, we process your personal data based on your consent for the purpose of handling your inquiry or complaint. We may process the following personal data about you: first name, last name, telephone number, email address, order data. Closed customer service inquiries and complaints are routinely deleted, no later than 4 years after the inquiry or complaint has been handled.

2.5 Reviews. Our customers' reviews are important to us. We will publish reviews if you give us your consent (if you leave a review about a specific product or service). We may process the following personal data about you: first name, last name, email address, order data. With your explicit consent, we will also process photographs and personal data included in the review text. Reviews are retained until you withdraw your consent, but no longer than 5 years.

2.6 Customer ratings. You can share your shopping experience and rate individual products. To evaluate your feedback on purchased products, we may use other Processors.

2.7 Legal obligations. Personal data may be transferred to third parties, in addition to the Processors mentioned below, if required by law or in response to lawful requests from public authorities or at the request of a court in litigation.

2.8 Age restriction. For products subject to age restrictions, we verify whether you have reached the minimum age required under applicable law. To do so, we use an identification service that enables us to verify your age.

2.9 Digital products. If it is necessary to update products with digital elements or digital products, we process the data you provided when placing the order.

3.1 Emails we may send. As part of selling our products or services, we may send customers emails related to:

4. Processors

Your personal data may be transferred to our business partners (Processors) or other third parties if required by law.

We use only verified Processors with whom we have a written contract and who offer us at least the same guarantees that we offer you. These are exclusively Processors from the European Union, or from countries that have been declared and recognized as safe, or from countries with which we have standard contractual clauses in accordance with Article 46 of the GDPR and that provide your personal data with a level of protection comparable to that afforded by the GDPR and Czech legislation. All these Processors are obliged to maintain confidentiality and may not use the personal data provided for any purpose other than those we have permitted them to use in accordance with these policies.

Where can you contact us? Write to us at the email address info@pelek.eu, or at the address of our registered office.

When will we resolve it? We will respond to you within one month at the latest. If providing the information would compromise the privacy of other people, or if providing the information poses a disproportionate risk or cost, we may be unable to comply with your request. In the case of repeated requests, the controller shall be entitled to charge a reasonable fee for a copy of the personal data.

Right of access. Confirmation of whether we process your personal data. Information about the purposes of processing, categories of personal data, recipients to whom they have been made accessible, processing period, and the existence

the right to ask the controller to exercise one of the rights mentioned below. The condition is that the rights and freedoms of other people are not adversely affected.

Right to rectification. Request the correction of inaccurate personal data.

Right to erasure. If there is no other reason to continue processing this data, we will delete or anonymize the data you have requested.

Right to restrict processing. If you believe that we are processing the data incorrectly, whether because of the processing grounds or its scope, please let us know.

Right to be notified of rectification, erasure, or restriction of processing. If you contact us with a request, we will inform you of the outcome unless this is impossible (for example, if the email address from which you wrote to us no longer works).

Right to data portability. Upon your request, we can provide the data you have provided to us in a structured, machine-readable format to another controller.

Right to object. If we process your data on the basis of a legitimate interest (for example, sending newsletters), it is our responsibility to demonstrate our legitimate interest; if you are right, we will stop carrying out this processing.

Right to withdraw consent. If you have changed your mind, please write to us. Processing related to marketing and commercial purposes may be withdrawn at any time.

Automated individual decision-making, including profiling. You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. We respect your rights, so we do not carry out profiling.
